The terms of using this site and working with the studio

Burgundy is a web design and development studio operated by Pranay Jain, based in Bangalore, India. References to "we," "us," "our," and "the studio" mean Burgundy. References to "you" mean visitors to burgundy.studio and prospective or active clients.

By using burgundy.studio, you agree to these terms. If you don't agree, please don't use the site.

If you engage Burgundy for a project, the project-specific agreement (a signed proposal, statement of work, or master service agreement) takes precedence over these site terms wherever they overlap.

Burgundy.studio is the public website of the studio.
It exists to:

• Explain what Burgundy does
• Show selected work
• Offer free audits
• Make it easy to start a conversation

You can read it, share it, and link to it freely.

Don't:

• Scrape the site at scale or in a way that disrupts service
• Copy site copy, design, code, or work samples to use as your own
• Pretend to represent Burgundy or use the Burgundy name
• Submit false information through forms
• Attempt to access parts of the site that aren't public

If you'd like to reference Burgundy publicly (in writing, talks, or press), please email hello@burgundy.studio first.

All content on burgundy.studio (writing, design, code, screenshots, brand assets) is owned by Burgundy unless explicitly credited otherwise.
You can:

• Read it
• Share links to it
• Quote short excerpts with attribution
• Cite work shown in the portfolio with credit to the client

You can't:

• Republish full pages
• Use Burgundy work or copy in your own portfolio without permission
• Use the Burgundy name, logo, or visual identity

Client work shown on the site is published with permission. Some projects are intentionally not shown (NDA, sensitivity, or client preference).

If you engage Burgundy for a project, the following applies. Project-specific agreements may add or override.

Scope. Each project has a written scope locked at the start. Out-of-scope work is handled through a written change request with a revised quote and timeline.

Payments. Standard milestone billing for Build and Migrate engagements: 40% to start, 30% at design sign-off, 30% at launch. Retainers billed monthly in advance. Audits are free. Invoices are due within 14 days unless otherwise agreed.

Late payments. Work pauses after 14 days overdue. After 30 days, the project may be archived and a restart fee applies if you want to resume.

Intellectual property on client work. On final payment, you own the final delivered site (design, code, content). Burgundy retains the right to show the work in its portfolio, in case studies, and in marketing materials unless we agree otherwise in writing in advance.

Confidentiality. We respect what you share. Standard NDAs are signed when requested before the first call.

Termination. Either party can end an engagement in writing with reasonable notice. Work delivered up to the termination date is invoiced and due. Work not yet started is not invoiced.

The site is provided "as is." We aim to keep it up, accurate, and useful, but:

• We don't guarantee the site will always be available
• We don't guarantee every link or download is current
• Tools, recommendations, or examples on the site are general and not specific advice for your business

To the extent allowed by Indian law:

• Burgundy is not liable for indirect, incidental, or consequential damages from your use of the site
• Our total liability under these terms is limited to the value of services you have paid us in the preceding 12 months, or INR 25,000, whichever is greater

These limits do not apply to liability that cannot legally be limited.

These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka.

We may update these terms from time to time. The "Last updated" date at the top tells you when. Continued use of the site after a change means you accept the updated terms.

For active client engagements, changes to these site terms don't override the signed project agreement.
